These Terms of Use govern your access to and use of beefyreturns.com (the "Site"), which is owned and operated by Beefy Returns, LLC, a Florida limited liability company ("Beefy Returns," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.

1. Who We Are

Beefy Returns operates a regenerative beef cattle ranch in Nicaragua and offers cattle purchase programs to qualified buyers. The Site provides general information about our operations, our programs, and how to contact us. Cattle purchase transactions are completed under separate written agreements, not through the Site.

2. Eligibility

You may use the Site only if you are at least 18 years old and capable of forming a binding contract. By using the Site, you represent that you meet these requirements.

3. Nature of the Information on the Site

The information on the Site is provided for general informational purposes only. Nothing on the Site is intended as, and nothing on the Site should be interpreted as:

  1. An offer to sell or a solicitation of an offer to buy any security.
  2. Investment, financial, tax, or legal advice.
  3. A guarantee of future returns, proceeds, or program performance.

Cattle purchase programs described on the Site are structured as direct cattle asset purchases under written purchase agreements between Beefy Returns and the buyer. Historical performance figures reflect past program results and are not a guarantee of future results. 4. Intellectual Property

All content on the Site, including text, photographs, video, graphics, logos, the Beefy Returns name and brand, and the Site's design and structure, is owned by Beefy Returns or its licensors and is protected by U.S. and international intellectual property laws.

You may view and download content from the Site for your personal, non-commercial use only. You may not copy, reproduce, republish, modify, distribute, or create derivative works from any Site content without our prior written consent. The Beefy Returns name and logo may not be used in any way that is likely to cause confusion or to imply endorsement, sponsorship, or affiliation without our prior written consent.

5. Acceptable Use

When using the Site, you agree not to:

  1. Use the Site in any way that violates applicable law or these Terms of Use.
  2. Attempt to gain unauthorized access to any part of the Site, our servers, or any system or network connected to the Site.

To the fullest extent permitted by law, Beefy Returns disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and availability.

We do not warrant that the Site will be uninterrupted, secure, or free of errors, viruses, or other harmful components. You are responsible for safeguarding your own systems and data when using the Site.

9. Limitation of Liability

To the fullest extent permitted by law, Beefy Returns and its members, managers, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site, including loss of profits, loss of data, loss of goodwill, or business interruption, even if we have been advised of the possibility of such damages.

Our total liability for all claims arising out of or related to your use of the Site is limited to one hundred United States dollars ($100). This limitation applies regardless of the legal theory on which the claim is based and survives any failure of essential purpose of any limited remedy.

Nothing in these Terms of Use limits liability that cannot be limited or excluded under applicable law.

10. Indemnification

You agree to indemnify and hold harmless Beefy Returns and its members, managers, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms of Use, or your violation of any law or third-party right.

11. Governing Law and Dispute Resolution

These Terms of Use are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms of Use or your use of the Site that the parties cannot resolve by good-faith negotiation within 30 days will be submitted to binding arbitration in Miami-Dade County, Florida, under the Commercial Arbitration Rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

To the extent any claim is not subject to arbitration, you and Beefy Returns submit to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

Class action waiver. Disputes will be resolved on an individual basis. You and Beefy Returns each waive any right to bring or participate in a class, collective, or representative action.

12. Changes to These Terms

We may update these Terms of Use from time to time. The current version is always posted on the Site, with the "Last updated" date at the top. Material changes will be reflected by an updated effective date and, where appropriate, additional notice on the Site. Your continued use of the Site after an update means you accept the revised Terms of Use.

13. International Users

The Site is operated from the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for complying with applicable local laws.

14. Severability and Entire Agreement

If any provision of these Terms of Use is held invalid or unenforceable, that provision will be modified to the minimum extent necessary, or severed if modification is not possible, and the remaining provisions will remain in effect. These Terms of Use, together with the Privacy Policy and the Risk and Forward-Looking Statements Disclaimer, are the entire agreement between you and Beefy Returns regarding your use of the Site.

Beefy Returns, LLC ("Beefy Returns," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect through beefyreturns.com (the "Site"), how we use it, when we share it, and the rights you have over it.

4. How We Share Information

  1. Service providers. We use vetted third-party providers for website hosting, email delivery, analytics, and similar functions. These providers process information on our behalf and only as needed to perform their services.
  2. Affiliates and operational partners. We may share information with Viking Cattle, LLC, which acts as our financial intermediary for cattle purchase transactions, and with our ranching team in Nicaragua, only where necessary to respond to your inquiry or fulfill a buyer relationship under a separate written agreement.
  3. Legal and protective disclosures. We may disclose information if required by law, valid legal process, or to protect the rights, property, or safety of Beefy Returns, our buyers, or others.
  4. Business transfers. If Beefy Returns is involved in a financing, merger, acquisition, restructuring, or sale of assets, information may be transferred as part of that transaction, subject to standard confidentiality protections.

5. International Data Transfers

Beefy Returns is based in the United States, and our ranching operations are in Nicaragua. If you are located outside the United States, your information will be transferred to, processed in, and stored in the United States and, where relevant, Nicaragua. These countries may have data protection laws that differ from those in your country.

Where required, we rely on appropriate safeguards for international transfers, including the European Commission's Standard Contractual Clauses (and the UK International Data Transfer Addendum where applicable). 6. Data Retention

We retain personal information for as long as needed for the purposes described in this Policy, including to respond to your inquiries, comply with our legal and tax obligations, resolve disputes, and enforce our agreements. Inquiry and contact-form information is generally retained for up to 36 months after the last substantive contact, unless a longer period is required by law or by an active business relationship.

7. Your Privacy Rights

EU/UK/Swiss residents

Subject to applicable law, you have the right to:

  1. Access the personal data we hold about you.
  2. Request correction of inaccurate or incomplete personal data.
  3. Request deletion of your personal data.

You may use an authorized agent to submit a request on your behalf, subject to our verification of the agent's authority.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. No system is completely secure, and we cannot guarantee absolute security. If we become aware of a breach that affects your personal information, we will notify you and applicable authorities as required by law.

9. Children's Privacy

The Site is not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has provided us personal information, please contact us at the address below and we will delete it.

10. Do Not Track
